Foi um cen\u00e1rio de elevada inadimpl\u00eancia e rescis\u00f5es de contratos de aquisi\u00e7\u00e3o. Entre os fatores que contribu\u00edram para essa realidade est\u00e3o a elevada taxa de desemprego, falta de planejamento financeiro e, mais recentemente, a crise econ\u00f4mica que atingiu drasticamente o pa\u00eds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-9l3f1\">O setor imobili\u00e1rio, com a crise nacional, viu-se diante de um colapso econ\u00f4mico ainda maior. Os valores negociados na planta se tornaram exorbitantemente maiores do que o valor do bem na entrega das chaves. Com isso, muitos compradores desfizeram o neg\u00f3cio e acionaram os meios jur\u00eddicos para a devolu\u00e7\u00e3o dos valores pagos com dedu\u00e7\u00f5es n\u00e3o abusivas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-f76rl\">O volume de a\u00e7\u00f5es judiciais discutindo os direitos no setor imobili\u00e1rio suscitou, em 2018, a Lei do Distrato (n\u00ba 13.786\/18). Trata-se de uma norma que retrata direitos e deveres das partes envolvidas na rescis\u00e3o de contratos de aquisi\u00e7\u00e3o de bens im\u00f3veis em regime de incorpora\u00e7\u00e3o ou loteamento.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-bcih2\">A Lei do Distrato determina que o comprador que desistir do im\u00f3vel negociado na planta, em patrim\u00f4nio de afeta\u00e7\u00e3o \u2013 segrega\u00e7\u00e3o patrimonial de bens do incorporador para uma atividade que assegura a entrega mesmo com sua fal\u00eancia \u2013 poder\u00e1 receber, em at\u00e9 30 dias, 50% do valor pago \u00e0 construtora como multa de rescis\u00e3o de contrato. J\u00e1 para o neg\u00f3cio que n\u00e3o estiver com o patrim\u00f4nio assegurado, a norma estipula a devolu\u00e7\u00e3o, em at\u00e9 180 dias, de 25% do valor pago como multa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-2o0kt\">Est\u00e1 previsto na nova norma que a desist\u00eancia da compra do im\u00f3vel poder\u00e1 acontecer em sete dias \u2013 contados ap\u00f3s a compra \u2013 nos pr\u00f3prios estandes de venda. Nesses casos, devem ser devolvidos todos os valores pagos antecipadamente, incluindo a comiss\u00e3o de corretagem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-2joaf\">Um outro ponto importante do texto determina que as incorporadoras devem apresentar todas as informa\u00e7\u00f5es sobre a transa\u00e7\u00e3o do neg\u00f3cio: o valor total da compra, a parcela de entrada, valor da corretagem, as parcelas e seus vencimentos e as taxas de juros e as determina\u00e7\u00f5es para a rescis\u00e3o do contrato de compra. Caso falte qualquer informa\u00e7\u00e3o no ato da aquisi\u00e7\u00e3o, a empresa ter\u00e1 30 dias para corre\u00e7\u00e3o, sob pena de justa causa para rescis\u00e3o contratual pelo comprador.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-69cc2\">\u00c9 importante destacar ainda que a Lei do Distrato aborda o atraso na entrega do im\u00f3vel. Ela estabelece o prazo de at\u00e9 180 dias de prorroga\u00e7\u00e3o sem a incid\u00eancia de multa. Ap\u00f3s esse prazo, o comprador poder\u00e1 pedir a rescis\u00e3o, com a devolu\u00e7\u00e3o de todos os valores pagos, ou, no caso do n\u00e3o rompimento de contrato, a incorporadora dever\u00e1 desembolsar uma indeniza\u00e7\u00e3o de 1% do valor pago para cada m\u00eas de atraso, com corre\u00e7\u00e3o monet\u00e1ria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-d72bh\">Mesmo com as novas diretrizes em vigor, existem diferentes interpreta\u00e7\u00f5es da Lei do Distrato e d\u00favidas sobre a extens\u00e3o das multas aplicadas. No entanto, adquirente e incorporador devem respeitar as normas atuais e as limita\u00e7\u00f5es na liberdade contratual.
