{"id":622,"date":"2021-04-22T17:26:00","date_gmt":"2021-04-22T20:26:00","guid":{"rendered":"https:\/\/rdcadvogados.com\/?p=622"},"modified":"2023-08-03T17:27:43","modified_gmt":"2023-08-03T20:27:43","slug":"condominios-residenciais-podem-impedir-uso-de-imoveis-para-locacao-pelo-airbnb","status":"publish","type":"post","link":"https:\/\/www.rdcadvogados.com\/site\/condominios-residenciais-podem-impedir-uso-de-imoveis-para-locacao-pelo-airbnb\/","title":{"rendered":"Condom\u00ednios residenciais podem impedir uso de im\u00f3veis para loca\u00e7\u00e3o pelo Airbnb"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\" id=\"viewer-foo\">A Quarta Turma do Superior Tribunal de Justi\u00e7a decidiu que caso a conven\u00e7\u00e3o do condom\u00ednio preveja a destina\u00e7\u00e3o residencial das unidades, os propriet\u00e1rios n\u00e3o poder\u00e3o alugar seus im\u00f3veis por meio de plataformas digitais como o Airbnb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-7c1hq\">Para o colegiado, o sistema de reserva de im\u00f3veis pela plataforma digital \u00e9 caracterizado como uma esp\u00e9cie de contrato at\u00edpico de hospedagem \u2013 distinto da loca\u00e7\u00e3o por temporada e da hospedagem oferecida por empreendimentos hoteleiros, que possuem regulamenta\u00e7\u00f5es espec\u00edficas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-e3kmh\">Seguindo esse entendimento, os ministros mantiveram ac\u00f3rd\u00e3o do TJRS que determinou aos propriet\u00e1rios de duas unidades residenciais em condom\u00ednio que se abstivessem de oferecer seus im\u00f3veis para esse tipo de loca\u00e7\u00e3o. O TJRS concluiu que essa pr\u00e1tica se caracteriza como atividade comercial e de hospedagem, proibida pela conven\u00e7\u00e3o condominial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-avabq\">De acordo com o magistrado, o condom\u00ednio n\u00e3o \u00e9 contra o contrato de aluguel de longa dura\u00e7\u00e3o, mas questionou a explora\u00e7\u00e3o de hospedagem remunerada, como um motivo de inseguran\u00e7a e perturba\u00e7\u00e3o aos demais cond\u00f4minos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"viewer-6rinr\">O ministro apontou que o C\u00f3digo Civil, ao mesmo tempo em que reconhece ao propriet\u00e1rio o direito de dispor livremente de sua unidade residencial, tamb\u00e9m lhe imp\u00f5e o dever de observar a sua destina\u00e7\u00e3o e us\u00e1-la de maneira n\u00e3o abusiva, com respeito \u00e0 conven\u00e7\u00e3o do condom\u00ednio \u2013 instrumento com for\u00e7a normativa, segundo o pr\u00f3prio c\u00f3digo.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Quarta Turma do Superior Tribunal de Justi\u00e7a decidiu que caso a conven\u00e7\u00e3o do condom\u00ednio preveja a destina\u00e7\u00e3o residencial das unidades, os propriet\u00e1rios n\u00e3o poder\u00e3o alugar seus im\u00f3veis por meio de plataformas digitais como o Airbnb.
